According to Statistics Canada, <a href=\"https:\/\/www150.statcan.gc.ca\/t1\/tbl1\/en\/tv.action?pid=3510019501\">over 100 Canadians die each year from residential fires<\/a>. \u00a0In some cases, fire safety negligence can land the landlord in legal trouble.<\/p>\n<p>Given the potential legal risks associated with fire safety, it doesn\u2019t make sense to leave this issue to chance.<\/p>\n<p>In this article, we\u2019ll explain every landlord\u2019s fire safety responsibilities, where to find the relevant information and go over 7 tips that can help prevent fire damages, injuries or deaths.<\/p>\n<p>&nbsp;<\/p>\n<h3><b>What Are a Landlord\u2019s Responsibilities When It Comes to Fire Safety?<\/b><\/h3>\n<p>&nbsp;<\/p>\n<p>Back in August,<strong> <a href=\"https:\/\/www.cbc.ca\/news\/canada\/british-columbia\/vancouver-apartment-fire-in-court-1.6936416\">landlords of a Vancouver apartment block appeared in court<\/a><\/strong> over a fire that displaced more than 70 residents and sent five people to hospital, over fire bylaw infractions at the building.<\/p>\n<p>The incident highlights the fact that there are specific fire safety requirements landlords must meet. \u00a0For the most part, these are straightforward:<\/p>\n<ul>\n<li>Have smoke and carbon monoxide detectors in specific areas of the property<\/li>\n<li>Test smoke and carbon monoxide detectors at specific times of the year<\/li>\n<li>Have at least two emergency exits per dwelling<\/li>\n<li>Provide fire safety information to your tenants<\/li>\n<li>Respond to fire safety-related issues when communicated by tenants<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><b>Is There Province-Specific Fire Safety Information for Landlords?<\/b><\/h3>\n<p>&nbsp;<\/p>\n<p>Each province has additional requirements landlords must meet. For example, in Manitoba, landlords must keep a log of smoke alarm testing. \u00a0Landlords should familiarize themselves with their specific laws, regulations and obligations by contacting their local fire station. Note that municipalities may also have additional requirements which is why the information in this article is for informational purposes.<\/p>\n<p><b>Ontario: <\/b>Landlords are required to provide working smoke alarms; tenants are required to maintain those alarms in working condition. By law, all single family homeowners and property owners in buildings that contain no more than six suites are required to have a working carbon monoxide (CO) alarm outside all sleeping areas.<\/p>\n<p><strong>Alberta<\/strong>: Under the Alberta Fire code, all dwelling units are required to be protected by a smoke alarm. a place where people might sleep, eat and\/or cook. Smoke alarm requirements are dependent upon the year of construction or renovation.<\/p>\n<p>&nbsp;<\/p>\n<h3><b>What Are Some Fire Safety Tips Landlords Can Implement?<\/b><\/h3>\n<p>&nbsp;<\/p>\n<p>Regardless of where in Canada your rental is located, there\u2019s a number of things you can do to promote fire safety and prevent accidents.<\/p>\n<p>&nbsp;<\/p>\n<h4><b>#1: Show Your Tenants the Fire Safety Risks of Your Rental<\/b><\/h4>\n<p>&nbsp;<\/p>\n<p>On moving day, show your tenant the basic fire safety precautions you implemented in your rental. \u00a0These includes:<\/p>\n<ul>\n<li>Showing the main emergency exits<\/li>\n<li>Asking the tenant to keep the emergency exits clear<\/li>\n<li>Explaining where the smoke and carbon monoxide detectors are<\/li>\n<li>Asking the tenant to test these alarms monthly<\/li>\n<li>Showing where the fire extinguishers are<\/li>\n<li>Reminding the tenant of his or her obligations to report fire safety issues to you when they come up<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h4><b>#2: Fulfil Provincial and Municipal Fire Safety Requirements<\/b><\/h4>\n<p>&nbsp;<\/p>\n<p>Prior to renting out a unit, landlords should contact their local fire safety professionals. \u00a0Some municipalities can even send a qualified professional to the property for an inspection and consultation. \u00a0This is a great way for landlords to get free advice tailored to their specific units.<\/p>\n<p>&nbsp;<\/p>\n<h4><b>#3: Check All Smoke Detectors Every Time You Enter the Unit<\/b><\/h4>\n<p>&nbsp;<\/p>\n<p>Whenever you enter the rental, regardless of the reason, take a few moments to <a href=\"https:\/\/www.exquisiteelectric.com\/blog\/testing-carbon-monoxide-smoke-detectors\/\">test the smoke and carbon monoxide alarms<\/a>.<\/p>\n<p>Landlords should keep a log of the dates they tested the alarms. \u00a0Although it\u2019s not a requirement in every province, it can come in handy if ever the landlord is brought to court over fire safety issues.<\/p>\n<p>If one of the alarms isn\u2019t functional, put in new batteries or replace the alarm as soon as possible. \u00a0If the replacement or repair will take more than a few hours, advise the tenant.<\/p>\n<p>&nbsp;<\/p>\n<h4><b>#4: Leave a Fire Extinguisher in the Kitchen for the Tenants<\/b><\/h4>\n<p>&nbsp;<\/p>\n<p>According to the Red Cross, <a href=\"https:\/\/www.redcross.org\/content\/dam\/redcross\/atg\/PDF_s\/Preparedness___Disaster_Recovery\/Disaster_Preparedness\/Home_Fire\/FireFAQs.pdf\">most residential fires start in the kitchen<\/a>. \u00a0That\u2019s why every landlord should leave a functioning and easy to use fire extinguisher in their tenant\u2019s kitchen.<\/p>\n<p>A basic fire extinguisher can be purchased in any hardware store. \u00a0Most models are small enough to fit under the kitchen or in the food pantry. \u00a0Given that <a href=\"https:\/\/support.firstalert.com\/s\/article\/How-long-do-fire-extinguishers-last#:~:text=When%20do%20fire%20extinguishers%20expire%3F&amp;text=Although%20they%20don't%20have,be%20replaced%20every%2010%20years.\">they have expiration dates<\/a>, landlords should get extinguishers checked at a nearby fire station. \u00a0It\u2019s free and if there\u2019s a problem with the unit, some fire departments offer free replacements.<\/p>\n<p>&nbsp;<\/p>\n<h4><b>#5: Check If Emergency Exits Are Clear After Move-In<\/b><\/h4>\n<p>&nbsp;<\/p>\n<p>Sometimes when tenants move in, items or furniture that were brought from the previous rental may not fit in the new one. \u00a0When this happens, some tenants stack these objects near exits. Unfortunately, blocked emergency exits are a leading cause of fire deaths in Canada.<\/p>\n<p>Once your tenant has settled in, call to make sure at least two of the emergency exits are clear. \u00a0If you\u2019re in the area and your tenant is informed, you can conduct this visual check yourself.<\/p>\n<p>&nbsp;<\/p>\n<h4><b>#6: Ensure Heat Sources Aren\u2019t Easily Accessible<\/b><\/h4>\n<p>&nbsp;<\/p>\n<p>If your rental uses baseboard heaters, ensure that the heating elements can\u2019t easily come into contact with foreign objects. \u00a0Fabrics such as clothing or curtains can catch on fire if they touch these elements.<\/p>\n<p>Most modern baseboard heaters are fully covered units. \u00a0However, older baseboards sometimes have covers which expose the heating elements.
